General Terms and Conditions for Purchases in the Beauty Fellows Online Shop

§ 1 General, scope of application of the GTC

1.1 All deliveries and services are provided exclusively on the basis of the following General Terms and Conditions (hereinafter “GTC”) in the version valid at the time of the order.

1.2 The purchase contract is concluded with Mangano GmbH, Zugerstrasse 76b, 6340 Baar, Switzerland, represented by the members of the Board (hereinafter “Seller”).

1.3 Our online store is aimed exclusively at consumers (hereinafter “Customer”). A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that are predominantly outside his trade, business or profession.

§ 2 Conclusion of contract

2.1 The offers and product presentations do not constitute a binding offer. By placing an order, you submit a binding offer in accordance with § 145 BGB, which we can accept. After placing your order, you will first receive an order confirmation by e-mail. Upon acceptance of your order by us, you will receive an order confirmation by e-mail, whereby the contract is concluded.

2.2 Once you have found the product you want, you can view it in detail by clicking on the product name or the product image. You can add the product to your shopping cart by clicking the [Add to cart] button. You can view your shopping cart at any time by clicking on the [Shopping cart] button. You can remove or change products in your shopping cart by clicking on [Edit] or [Delete]. If you wish to purchase the products in your shopping cart, click on [Checkout].

2.3 During the ordering process, you create a customer account for your first purchase and select the shipping and payment method. In the last step under “Order overview” you will receive a summary of your order data and can check, delete or change your details. You can correct input errors by going back in the browser or by canceling and restarting the order process. By clicking the [Buy] button, you submit a binding offer and send your order to us.


§ 3 Storage of the contract text
We store your order, the order data entered and the complete text of the contract. You will receive an order confirmation by e-mail containing all the order data and the complete text of the contract.

§ 4 Right of withdrawal for consumers

You have the right to cancel this contract within fourteen days without giving any reason.

The revocation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods.

To exercise the right of withdrawal, you must inform us (Mangano GmbH, Zugerstrasse 76b, 6340 Baar, Switzerland, hello@beautyfellows.ch) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail).

To comply with the withdrawal period, it is sufficient for you to send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of withdrawal:

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract.
For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this repayment.
We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earliest.

You must return or hand over the goods to us immediately and in any case within fourteen days at the latest from the day on which you inform us of the revocation of this contract. The deadline is met if you send the goods before the period of fourteen days has expired.

You shall bear the direct costs of returning the goods.

You shall only be liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

2. exclusion of the right of withdrawal
The right of withdrawal does not apply to contracts for the delivery of:

Goods which are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer,

goods that can spoil quickly or whose expiration date would be quickly exceeded,

sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery,

goods which, due to their nature, have been inseparably mixed with other goods after delivery.

§ 5 Sample withdrawal form

§ 6 Prices and shipping costs

All prices are inclusive of VAT plus shipping costs.
We deliver with [DPD, UPS, Swiss Post etc.] or another shipping service provider of our choice.

Shipping costs per delivery:

• Switzerland: CHF 6.90
  
• Italy, Austria, Germany: EUR 6.90
• Other EU countries: EUR 9.90

 

§ 7 Terms of delivery

We only deliver within Switzerland and the EU.
Delivery times from receipt of payment:

• Switzerland: 2-5 working days
• Italy and Austria: 3-7 working days
• Germany: 2-5 working days
• other EU countries: 3-8 working days

§ 8 Terms of payment

8.1 Payment shall be made by credit card (VISA, Mastercard, American Express, Discover), iDEAL, Bancontact or PayPal. We reserve the right to exclude individual payment methods.

8.2 The goods remain our property until full payment has been made.

§ 9 Warranty and liability

The statutory liability for defects shall apply, unless otherwise regulated.
Liability for damages shall be governed by the provisions contained in the complete document.

§ 11 Miscellaneous

11.1 The contract language is originally German, this is just a translation.

11.2 Should any provision of these GTC be invalid, the remainder of the contract shall remain valid. The invalid provision shall be replaced by the statutory provisions.
